FUCKING TWAT DRIVERS

    There seems to be 2 issues arising here:
    1. Should you or shouldn't you have gone past the golf:

    - The law states that as long as traffic is moving at below the speed limit and it is safe to do so, you may overtake.

    - On white lines or double white lines, as long as the vehicle is doing less than 10 or 15mph (would have to look it up) it is legal to overtake as long as it is safe to do-so.

    Personally, from what you've said, i would have done the same, there is a gap and its safe to go, you go, not sit there like a lemon waiting for him to sort himself out.

    2. The Golf driver is a cunt:

    - Get to your local Cop-shop, explain EXACTLY what happened to them, not leaving out any detail, explain how he was stopped in the road, you went past him, only to find him coming past you at high speed (don't try to hazzard a guess at his speed because it's impossible to do) then hit the brakes hard as soon as he pulled infront of you, you had no chance of braking as hard as he did because bikes just don't have that sort of stopping power.

    As long as you report exactly what happened to the police, they have no option but to take further proceedings as it could be classed as attempted manslaughter if they are willing to go the whole hog. Get your story in first.

    as for the golf, if he ends up winning the case, post his details up on here, there's nothing a good old brake fluid bomb can't sort out.

    lol at the brake fluid bomb wobbly , was personally thinking more along the lines of a litre of homebase paint stripper lol

    his golf was stationary when i overtook him , and there is no white lines on that road as its a bit out of the way , ther was no oncoming traffic either

    a few problems have come up though, having lost his details drivng home after the crash i dont know whether i should go to the old bill now or wait till his insurance gets in contact

    also the roads limit was 30 , a ridiculous limit for the road tbh is long straight and open , but i was doing 50+ and still acelerating , but he absoluteley flew past me i reckon 70+ i dont know ether or not to bring speeds into it because we will both end up in shit for that

    ok, tell the old bill, but leave out the fact you were speeding, if they ask you how fast you were going just say you don't really know, there is no proof of what speed you were doing. explain to them that you lost his details. it puts you in the right, its YOUR duty to report ANY contact with another vehicle whilst driving, otherwise if he reports it and you don't, action can be taken against you for not reporting an incident you were involved in. just go and explain exactly what happened, they can't arrest you for anything or confiscate the bike, they will keep your details and if there is any follow up they will be in contact.

    true, chris has the right lines there. Shouldnt have really gone round, should have waited for him to pull out! but then again he shouldnt slam his brakes on, but you WILL get the blame unless you get the the police as anyone who goes into the back gets the blame no matter what!

    if the police ask about speed, just say you was so worried about the golf hitting you that you didnt have time to look at the speedo....

    shame about losing the details though :(

    maybe it was safe. but a bit of patience would have avoided all of this.

    if he went through at 10mph and the car come behind him not too long after they wasnt waiting for ages obviously

    maybe a few secs.

    hindsight is great, the driver at fault was still the Golf driver.

    yeah he was out of order but all am saying is if he waited a few seconds could have saved all of this.

    he didnt go through at 10mph , he was stationry , i said I passed him at less than 10mph , maybe you should of gone to specsavers

    he isnt in the wrong what so i ever! i always go past stationary cars when their waiting to turn right or w/e. its one of the advantages of having a ped/bike :D
