100c 2 stroke scooters arent restricted mate. top speed after tuning would depend on what your planning to do to tune it....
could possibly be caused by starting without exhaust on, did he rev the granny out of it? if so there could be your problem. is the plug wet when...

sounds like an earthing problem mate, take off all the indicator connections and use a bit of sandpaper to clean them up. see if that works first.
depends what sort of exhaust it is, what pipe did you have and what pipe did you swap it for? i suspect its possibly the back pressure difference...
