    probably
iv seen a 55 aerox write off just for a few scratches and chunks missing from the side
if it is and your insured fully comp then dont worry
if your insured 3rd party iv got a few of the panels you need you can have cheap

if he said in writing that he saw you and he still pulled out its his fault.

should get it in writing as it he could change his mind when his insurance company get in touch with him, also where's the scooter at the moment?

ask for salvage retention on any cat d, repair, have it mot'd an its all good to go. you got payd out and kept the bike.. usually gets you a few tunning goodies and if provent o not be your fault it wont put your insurance up as its not your insurance your claming on

salvage retention means they sel;l you the bike out of the payout.. probably like 100 quid..

minor took the words right out of my mouth keep the bike they usually send someone round to have a look and tell them that you want to keep it and you will get it for like £100 and then get whatever you said the bike was worth, you could be a cunt as well to the driver if he wants to be a nobhead about things
