So my bike ran out off fuel wouldn't start cleaned the vaccum fuel pump carbaretor was cleaned a week before it started running was out on it for maybe 12 miles was slow reacting to throttle got home tried to start it today and it starts then immediately cuts out is this likely to be bad piston any help is appreciated

Im a little lost with the bad grammar. But you are saying it ran out of fuel, then 12 miles later, after its been filled again, it was running bad. And now it won't start?
    What bike is it?
    And when was last service?
Could just be the spark plug. Try a new one

Yes that is correct it was only at the mechanic a few weeks ago my clutch had stuck he cleaned everything and put a new spark plug in although it's looking black already it fires then immediately dies

    And it's a sym joyride 125 evo

I would suggest an oil change and valve clearance check.
I very much doubt its the piston at all.
Most probably its a fuelling issue. Black means too rich or burnt oil.
    How is the oil level?

I have just nipped out to check the oil it's sitting above the higher limit on the dip stick
