Right, i might have asked about this before but im in abit of a pickle now. i had a fiesta ages ago blah blah cought fire got written off...insurance company said right well send someone round to take the car away from you, give him every document you have for the car. so i did. an envelope with the mot, tax serivce book full logbook. and they will declared it scrapped. few weeks later i get a letter through from the dvla (in my dads name, the car was in his name) saying i have failed to change the name on the logbook? so i called them up saying ok i was told to give all the documents to the fat prick with the shitty tow truck what do you epect me to do? they said blah blah well have a word with the dvla, then i called the dvla they said yeah thats fine. we will sort it out. obviously i didnt wana bring my dad into it cuz hes a moody prick...plus i thought i had sorted it out.few days ago i get a letter saying hes due in court next month in enfeild for not changing the name on the logbook?, and i CANNOT tell him, so please dont say you have to tell him etc, he will fuck me over.and my mum. wtf am i meant to do? cheers for any help boys

funny enough jamie you could actually go to court as him, they don't ask for i.d or any thing :whistle: , not that im advising it, as its far from legal but an option if him finding out is that much of a no no. same thing happen to a guy i know, dvla took him to court for the same shit, and he was scratching his head cratch: thinking "i done what i was asked why am i here?" claim got thrown out of court after being adjourned to a later date. at some stage, some one's going to have to hand in there plea to the court, so you need to contact the dvla and ask wa gwan, why am i looking at a court summons over something you said was sorted?
cheers for the advice fire, apreciate it, and yeah i hear they dont ask for id? just as long as youve got the summons paper? well ive got someone lines up to go roughly the same age as my dad...but i dont want it to come to that, ive done what ive been told and im getting fucked over for it...and what a fucking waste of court time? ive been well and truely raped by this insurance company...they dont pay out for the car. charge me to have it removed, charge me again to cancel the policy. and the cunt with the tow truck obviously fixed it and sold it on.... its admiral btw people just for the referance. ill update tomorow after ive called up the Dickhole Vagina Licking Arseholes
i had sort of the same thing when my bike was taken by the police, dvla wanted me to renew the tax almost 8 months after it had gone! just foned and explained and they said fine... then i got a final warning threatening me to court. just ignore them! on the summons theres a plee page, so you dont have to go into court you just write a letter explaining what happened, and a copy of your write off notice if you have one still? and it will be fine
right your all slowly easing my mind abit thanks alot but if i cant find the blue slip the guy gave me how do i go about getting another one or is it possible if i explain in great details and give the names of the people from the dvla and my insurance company that told me it was all sorted they might throw it out without the write off slip? cheers for the help burns and fire fire burns lol
do you know the company that took your car? phone them up and ask for another copy just explain as much as you can, on the plea page theres only a little box, but you can write down more info on a extra piece of paper and staple it together :good:

If the cars been collected by the insurance and they've paid out then the cars in THEIR ownership hence you'd need a change on the V5. It'd then be up to the new owners to declare it as scrapped. As for someone else going to court...forget it. They'd be purguring themselves by trying to be someone they're not...and could end up being someones bitch coz the courts done take too kindly on that sort of thing :rules: and opening other peoples mail IS NOT illegal BUT stopping it reaching its destination IS. So if its been posted thro' the letter box to where its going then ita already reached its destination :thumbsup: I use this little titbit of info at work so i can legally open post to trace people :thumbsup:

in the case of scrap and salvage it is the job of the insurance company to notify of the scrappage of a vehicle... its there vehickle from the second they take it. if you have a recipt of this then you have nothing to worry about. so find your recipt they gave you for the car... it should have a listing of everything they took from you. ie the car, any docs and the like.. they NEED this for there own records to prove you didnt give them more than they recon (like missing v5's you later lie about and pretend they took them and so on) they will have a copy of this, request it. fact is, if the vehicle was paid for. the insurance company is OB+VIOUSLY liable regardless of paperwork.... an insurance company wont pay out if any SINGLE thing is wrong... courts know this
