so about 5 days 2 weeks ago i got my aerox back on road and i went around the block as i was coming back on a bend i had an accident collided with a women driver on oncoming traffic smashed her front windscreen. we exchanged my details as i am an insured party but we agreed to pay them the money for repairs we got all damage totalled upto about £200 Including Fitting at a garage(friends garagee heehehe free labour/discount hehe) so we agreed on cash. 3 days down the line they started to pull a fast one saying more things have been damaged and originally was like the boot and bonnet is damage and other things trying to get as much out of me as they can. only thing was damaged was front windscreen and a scuff on the front bumper only now have i recieved a Letter of claim from there solicitors and making a claim against the following 1. Excess/repairs/write off of motor vehicle to be quantified 2. recovery and storage of motor vehicle to be quantified 3. hire of replacement vehicle at a rate of £92.00 per day plus vat 4. miscellaneous expenses in the sum of £120 there reason is; we are alleging fault is that you failed to keep or any proper lookout failed to heed/observe the presence of position of our clients vehicle drove into collision with our clients vehicle and failed to means of brakes,gears, steering or otherwise to control your vehicle as to avoid collision. i know i should have notified my insurance company of accident but being learner i didnt have a clue haha so what should i do now? tbh my bike came off worth than the car i have calculated my bike damaged and theya re coming to around £250 only panels on one side damaged + seat smashed up however still 100% rideable not obstruction with riding eversince the accident occured i have had a background ache with my right arm shoulder and my back as been hurting due to crash but am i able to make a claim against them and get compensation? Need urgent help in what to do
was you on the correct side of the road and not riding like a tit? (no offence intended) firstly go and get yourself checked out if you have pain in your arm. (also can be used in a claim against her if you can prove she was liable) if you have any proof it was not your fault bloody argue and counter claim the insurance company,they are fucking c**ts and will try and try to scare you into accepting responsibility. if you have anything you can use against them such as witnesses or pictures of the incident use them as they will go well in your favour. but if it was your fault i would tell the insurance if they are trying to claim off you as you should have legal cover which you will definatly need and its what insurance is for. i remember when i had my big smash the other driver tried to sue me for drycleaning and a cup of coffee!! i argued he was driving without due care and attention due to drinking a coffee when he hit me a 50mph side on then i got a nice letter saying all the claims ended up coming off his insurance took nearly a year to settle but its worth it
Never admit liability ! even if you are liable, It is not down to you to prove your innocence, it is down to them to prove your guilt. Dont let them scare you even if you are at fault. As said above they are ruthless and will baffle you with scary words to accept responsibility so they dont have to pay for anything! you should have legal cover even if you are 3rd party only, USE IT! tell your insurance what happened and list any witnesses you can (even if that means local CCTV which captured it) Even if it was your own fault, tell them it was hers ! buy yourself some time, PM me for Iranian passport and fake money and flee the country before you end up on europes most wanted !!
